Please read these Terms of Service carefully before using myBrandDNA. By accessing or using our service, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using myBrandDNA ("the Service") at mybranddna.io, you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Operations Beast LLC ("we," "us," or "our"), the owner and operator of myBrandDNA.
2. Description of Service
myBrandDNA is an AI-powered personal branding platform that generates Brand DNA Profiles, LinkedIn content, resume summaries, content calendars, and outreach templates based on information you provide. The Service is available through subscription tiers including Believer, Blueprint, Builder, and Amplified.
3. Intellectual Property
Our Property: The myBrandDNA platform, including but not limited to its name, logo, design, software, code, algorithms, prompts, workflows, automation systems, website content, and all related intellectual property are owned exclusively by Operations Beast LLC. These are protected by copyright, trademark, and other applicable intellectual property laws.
Your Content: The Brand DNA Profile, LinkedIn posts, resume summaries, content calendars, and outreach templates generated for you based on your questionnaire answers are yours to use. You retain ownership of the personal information and answers you provide.
License to Use: We grant you a limited, non-exclusive, non-transferable license to use the Service and your generated deliverables for personal and professional purposes. You may not reproduce, distribute, modify, or create derivative works of the myBrandDNA platform or its systems.
Restrictions: You may not:
- Copy, reverse engineer, or replicate the myBrandDNA system, workflow, or business model
- Use the Service to build a competing product or service
- Resell or sublicense access to the Service without written permission
- Scrape, crawl, or extract data from the platform through automated means
- Remove or alter any copyright, trademark, or proprietary notices
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account. You may not share your account or allow others to access your account.
5. Subscriptions and Payments
Paid subscriptions (Blueprint, Builder, Amplified) are billed monthly. The Believer tier is a one-time payment. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Subscriptions can be cancelled at any time by contacting scott@mybranddna.io. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial months of service.
6. Referral Program
myBrandDNA operates a referral program that allows users to earn commissions by referring new customers. Referral commissions are earned when a referred user completes a qualifying purchase. Commission rates are: $2 flat for Believer signups, and 15% of the subscription value for Blueprint, Builder, and Amplified tiers. Commissions are paid manually via the payment method of your choosing. We reserve the right to modify or discontinue the referral program at any time with reasonable notice. Fraudulent referral activity will result in account termination and forfeiture of earned commissions.
7. AI-Generated Content
The deliverables generated by myBrandDNA are created using artificial intelligence based on the information you provide. You acknowledge that:
- AI-generated content may not always be perfectly accurate or suited to your specific situation
- You are responsible for reviewing and editing all generated content before use
- myBrandDNA does not guarantee specific outcomes from using generated content
- You should not rely on generated content as professional legal, financial, or career advice
8. LinkedIn Integration
If you connect your LinkedIn account, you authorize myBrandDNA to post content to your LinkedIn profile on your behalf on the schedule you select. You can revoke this authorization at any time through your account settings. You are responsible for ensuring that content posted to your LinkedIn complies with LinkedIn's Terms of Service.
9. Prohibited Uses
You agree not to use the Service to:
- Submit false, misleading, or fraudulent information
- Harass, defame, or harm others
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Attempt to gain unauthorized access to any part of the Service
- Interfere with the operation of the Service
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee that AI-generated content will meet your specific needs or produce particular professional outcomes.
11. Limitation of Liability
To the maximum extent permitted by law, Operations Beast LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the three months preceding the claim.
12. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data by contacting scott@mybranddna.io.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Orange County, Florida.
